Two Companies Cited With 10 Violations; $118K In Fines

OSHA cited Lunda Construction Inc. in Black River Falls along with Choice Construction Cos. Inc. in Menomonee Falls Thursday with 10 safety violations following a July accident where a truck driver was killed and another worker was seriously injured when a crane collapsed at a bridge construction site on U.S. Route 41.  Lunda is facing its fifth set of safety violations since  2009 and most recently was cited in October in another fatal accident.

This accident occurred July 5 over Lake Butte des Morts near Oshkosh. In the incident, the truck driver who was employed by Spancrete died when he was struck by the boom of the crane that overturned while bridge girders were being erected with a multiple crane lift.

A Lunda Construction employee operating the crane was serious injured when he was thrown from the cab as the crane fell. Lunda Construction was cited for one willful violation and five serious violations. According to OSHA, the willful violation was for failing to comply with crane operator standards by designating a lift director and conducting multiple crane-lift planning meetings. The serious violations included citations for allowing a crane to travel with a suspended load along with several failings to plan and carry out proper crane operations.

Choice Construction, a contractor for Lunda Contruction, was cited for four serious violations including failing to develop a safety program, conduct competent qualified training and comply with provisions of crane operating standards.

Lunda Construction has been placed in OSHA’s Severe Violator Enforcement Program, which focuses on employers who OSHA feels are endangering the safety of their workers by willful violations. They are facing $105,000 in fines for the violations and Choice Construction is facing $13,220 in fines for their violations.

Spancrete was not cited as a result of the investigation.

The two companies have 15 business days to comply with the citations, request a conference or contest the findings.
