OSHA Cites Company For 12 Violations In Employee’s Death

A Theresa, Wis. manufacturing plant has been fined $64,000 for 12 safety violations following the death of one worker and the hospitalization of another in November.

The Occupational Safety and Health Administration cited Vivid Image Inc. with violations following an investigation of the death of an employee due to chemical exposure. The 55-year-old man was killed and a 65-year-old man was hospitalized after being overcome by fumes in late November. They were found unconscious when the hospitalized man’s wife came to check on them.

OSHA cited the company for two willful violations for workers not wearing respiratory protection while working with the chemical toluene in an unventilated area as well as for exposure to toluene beyond the peak level of 500 parts per million. The company received 10 additional serious safety violations, including a failure to reasonably evaluate toluene air concentrations and a failure to shut off the ventilation system and block the exhaust duct while applying screen coating material containing toluene.

OSHA also placed the company in its Severe Violator Enforcement Program, mandating targeted follow-ups due to the severity and “willful nature” of some of the violations.

The company has 15 business days to comply with the penalties and citations, request an informal conference or contest the findings before the independent board.
