OSHA Fines Cudahy Co. $50K, Some For Repeat Violations

Joy-Mark Inc., a Cudahy, Wis. company, received citations for six health violations, including two repeat violations from the Occupational Safety and Health Administration Friday. OSHA proposed the company face $50,050 in fines as a result of the October 2012 follow-up inspection.

“Joy-Mark has a responsibility to monitor worker exposure to respiratory hazards and to provide and train workers on the proper use of appropriate respirators,” said Christine Zortman, OSHA’s area director in Milwaukee. “Employers who are cited for repeat violations demonstrate a lack of knowledge and commitment to protecting worker safety and health.”

The first repeat violation was allowing workers to use non-HEPA respirators, which OSHA says are ineffective in filtering respiratory hazard exposure.

The company was also cited a repeat violation for exposing workers to airborne refractory ceramic fiber above the recommended exposure limits as set by the National Institute for Occupational Safety and Health.

According to OSHA, these violations were previously cited at the Cudahy facility in 2009, 2010 and 2011. The company also received four citations for serious violations of OSHA’s respiratory protection standards, including a lack of medical evaluation for a worker required to wear a respirator, not conducting initial or annual respirator fit testing and allowing a respirator to be worn with a beard.

Joy-Mark was founded in 1978 and makes ceramic molds to be used as pouring aids in foundries. They currently employ 65 people at the facility.

They have 15 business days from receiving the citations to comply, request an informal conference or contest the findings.
