Milwaukee Worker’s Compensation Lawyer – OSHA Cites Milton Company After Worker Killed In Corn Bin

The company who owns a facility in Milton, Wis., where an employee was killed after getting trapped in a corn bin in April was cited for 15 health and safety violations and faces fines of $140,000. The company received the following citations:

  • One willful violation for failing to lockout conveyors used to empty grain bins, exposing the employee to the engulfment hazard.
  • Five serious violations, including failing to guard the floor chute opening and failing to prevent exposure to moving grain hazards.
  • Seven serious violations of OSHA’s Process Safety Management, including failing to develop emergency shutdown procedures for the ethanol distillation process and failure to perform inspections and tests on control systems.
  • Two other-than-serious violations involving failure to retrain ethanol distillation process operators at least every three years.

The company has 15 business days from the notice of the citations and fines to comply with the fines and fix the issues or contest the citations.
